Welcome to Oak Senior Benefits. This website, including all subdomains, blogs, newsletters, digital materials, and educational classes hosted herein (collectively, the "Platform"), is owned and operated by Oak Senior Benefits ("the Company," "we," "us," or "our"). By accessing, browsing, or using this Platform, or by submitting information through our digital questionnaires and subscription forms, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions of Use (the "Terms") and our accompanying Privacy Policy. If you do not agree to these Terms, you must immediately cease using this Platform.
1. Educational Content and No Professional Advice Disclaimer
All materials, articles, blog posts, email newsletters, video recordings, and live or recorded educational classes provided on this Platform are intended solely for general informational and educational purposes.
The procurement of insurance is highly individualized and dependent upon specific geographic locations, health statuses, prescription drug requirements, and financial parameters. No content on this Platform constitutes, nor should it be construed as, formal legal, financial, medical, or professional insurance advice.
Your use of this Platform, enrollment in a class, or subscription to a newsletter does not establish a broker-client relationship between you and the Company. A formal advisory relationship is only established upon direct, one-on-one consultation with a licensed insurance producer and the execution of an explicit scope of appointment or enrollment framework.
2. Third-Party Marketing Organization (TPMO) and CMS Disclosures
The Company operates as an independent insurance agency and a Third-Party Marketing Organization (TPMO). In compliance with the Centers for Medicare & Medicaid Services (CMS) regulations, we provide the following mandatory disclosure:
We do not offer every plan available in your area. Currently, we represent seven organizations which offer products in your area. Please contact Medicare.gov, 1-800-MEDICARE, or your local State Health Insurance Program (SHIP) to get information on all of your options.
Plan availability, benefits, allowances, and programmatic features are subject to geographic limitations and change each plan year.
3. Communications and Consent to Contact
By submitting your contact information, including your name, phone number, and email address, through any questionnaire, lead capture form, or newsletter subscription field on this Platform, you provide your express written consent to be contacted by a licensed insurance agent representing the Company.
You agree that the Company may contact you via email or telephone to discuss Medicare Advantage, Medicare Supplement, or Life Insurance products. This consent applies even if your telephone number is currently listed on any state or federal Do Not Call registry. You maintain the right to revoke this consent at any time by contacting us directly or utilizing the unsubscribe mechanisms provided within our electronic communications.
4. Intellectual Property Rights
The proprietary text, structural design, course curricula, educational layouts, graphics, and compilation of resources on this Platform are the exclusive intellectual property of the Company and are protected by United States and international copyright, trademark, and proprietary rights laws.
You are granted a limited, non-exclusive, non-transferable, and revocable license to view and download educational materials from this Platform strictly for personal, non-commercial use. You are expressly prohibited from copying, scraping, reproducing, redistributing, publishing, or modifying any content from this Platform for commercial purposes or competitor utilization without our prior written consent.
5. Limitation of Liability and Indemnification
To the maximum extent permitted by applicable law, the Company, its officers, directors, employees, and independent contractors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to, use of, or inability to use this Platform, or any errors or omissions contained within the educational text.
You agree to indemnify, defend, and hold harmless the Company and its licensed producers from and against any claims, liabilities, losses, expenses, or demands, including reasonable legal fees, arising out of your violation of these Terms or your misuse of the information provided on the Platform.
